Revisión dogmática del tratamiento del dolo como parte del tipo subjetivo: una deconstrucción argumentativa a partir de los esquemas del pensamiento penal y su crítica

Abstract

Bajo la presente investigación se pretende realizar una revisión del discurso dogmático que ha configurado el actual tratamiento del dolo en la doctrina mayoritaria, esto es, como parte del tipo subjetivo en el injusto penal. Se realiza una deconstrucción de cada uno de los esquemas del pensamiento penal a fin de demostrar cuál ha sido su evolución a lo largo de la historia dogmática del delito, lo que permite evidenciar qué ha justificado las diferentes variaciones presentadas en esta categoría dogmática, y qué consideraciones han conllevado a su actual estudio como parte subjetiva de la tipicidad. Se concluye que no existen argumentos actuales que de forma categórica permitan justificar el tratamiento del dolo como parte del tipo penal, planteando por último una aproximación a una figura jurídica de imputación subjetiva que permita la solución del problema.
