Abstract

El desarrollo de la propuesta investigativa tiene como finalidad demostrar cómo, a raíz de la vigencia de la Constitución Política de 1991, la responsabilidad extracontractual del Estado se modificó, en el sentido de que ostenta como único fundamento el elemento ¿daño¿, lo cual lleva a que sea menos importante o necesario el elemento intencional o subjetivo del autor del daño y cobra mayor relevancia, tanto para efectos de determinar el régimen de responsabilidad aplicable como para indemnizar los perjuicios sufridos por las víctimas, el resultado dañoso que experimenta el ofendido así en su patrimonio como en la órbita extra patrimonial. Y que los regímenes conocidos de responsabilidad (falla probada, falla presunta y regímenes objetivos) ya no son el fundamento sino que se convierten en recursos de la técnica jurídica destinados a hacer actuar la responsabilidad del Estado.
