Abstract

Hemos tenido el infortunio de encontrarnos ante un tema que carece de aplicabilidad en nuestro contexto. A veces, las verdades más obvias son comúnmente ignoradas, permanecen indiferentes justo ante nuestros ojos. El desarrollo de una teoría de la argumentación jurídica con miras a la solución del problema de legitimidad de la disciplina jurídica requiere, como sustrato mínimo, presentarse de cara a una sociedad con una legitimación, en buena medida, de carácter legal-racional, en términos de Weber. Una teorización que pretenda dar cuenta de cómo y en qué medida es posible la fundamentación racional de una decisión judicial, poco o nada dice de nuestra realidad. Una sociedad que espera encontrar el sentido de justicia en un caudillo, en el chamán, no es el contexto apropiado para hablar de racionalidad. Lo preocupante, y allí reclama cabal importancia esta monografía, es que las teorías de la argumentación son tema en boga de un tiempo para acá. No solo como el sueño de lo que algún día podría ser aplicado a nuestro contexto, sino como una realidad innegable e indiscutible. Se asume con plena certeza que la aplicación de estas teorías es apropiada a nuestro contexto y que, en efecto, dotan de racionalidad las decisiones judiciales. En nuestro país, el del Sagrado Corazón, sería más acertado afirmar que los límites al arbitrio del operador jurídico se encuentran en el artículo 413 del código penal (prevaricato) y en la amenaza de una investigación disciplinaria por parte del aún sobreviviente Consejo Superior de la Judicatura.

We have had the misfortune to find ourselves before a topic that lacks applicability in our context. Sometimes, the most obvious truths are commonly ignored, remain indifferent right before our eyes. The development of a theory of juridical argumentation with a view to solving the problem of legitimacy of legal discipline requires, as a minimum substratum, to present itself in the face of a society with a legitimation, to a large extent, of a legal-rational nature, in of Weber. A theorization that pretends to give an account of how and to what extent the rational foundation of a judicial decision is possible, says little or nothing about our reality. A society that expects to find a sense of justice in a caudillo, in the shaman, is not the appropriate context to speak of rationality. What is worrisome, and there claims that this monograph is very important, is that argumentation theories are a topic in vogue from time to time. Not only as the dream of what could one day be applied to our context, but as an undeniable and indisputable reality. It is assumed with complete certainty that the application of these theories is appropriate to our context and that, in effect, they give rationality to judicial decisions. In our country, that of the Sacred Heart, it would be more accurate to affirm that the limits to the discretion of the legal operator are found in article 413 of the penal code (prevaricato) and in the threat of a disciplinary investigation by the surviving Superior Council of the Judiciary.
