Abstract

La presente investigación tiene como propósito reflexionar acerca de la argumentación jurídica, la ponderación y su praxis, por la Corte Constitucional Colombiana en los siguientes fallos C-022 de 1996, T-629 de 2010 y C-077 de 2017. La hipótesis de trabajo es ¿la argumentación y ponderación jurídica se aplica en estos fallos de la Corte Constitucional? Para dar cuenta de lo anterior, se ha estructurado de la siguiente manera: el primer acápite denominado Teorías de la argumentación, presenta de manera sintética las teorías contemporáneas: la tópica jurídica, desarrollada por Theodor Viehweg, la nueva retórica expuesta por Chaim Perelman, la Teoría de la Argumentación Jurídica expuesta por Robert Alexy y el derecho como práctica argumentativa de Manuel Atienza. El segundo acápite, denominado prácticas jurídicas, tiene el propósito de reflexionar acerca de algunos casos connotados en diversas latitudes, por lo que serán expuestos de manera sintética, privilegiando en buena medida el problema y los argumentos de la parte resolutiva. En esta medida se puede analizar el derecho en casos prácticos. El tercer capítulo, Marco contextual argumentativo, establece las formas usuales de interpretación según la estructura dada a los silogismos. El numeral 4, denominado, La jurisprudencia como fuente formal del derecho en Colombia, hace una presentación sucinta de la jurisprudencia como fuente formal del derecho ajustada al desarrollo silogístico según casos particulares.

The purpose of this investigation is to reflect on the legal argumentation, the weighting and its praxis, by the Colombian Constitutional Court in the following decisions C-022 of 1996, T-629 of 2010 and C-077 of 2017. The working hypothesis Is the argumentation and legal weighting applied in these decisions of the Constitutional Court? To give an account of the above, it has been structured as follows: the first section called Theories of argumentation, presents in a synthetic way the contemporary theories: the legal topic, developed by Theodor Viehweg, the new rhetoric expounded by Chaim Perelman, the Theory of Legal Argumentation exposed by Robert Alexy and law as an argumentative practice of Manuel Atienza. The second section, called legal practices, has the purpose of reflecting on some cases connoted in different latitudes, so they will be presented in a synthetic manner, privileging to a large extent the problem and the arguments of the operative part. In this measure, the law can be analyzed in practical cases. The third chapter, Argumentative contextual framework, establishes the usual forms of interpretation according to the structure given to the syllogisms. Number 4, called, jurisprudence as a formal source of law in Colombia, makes a succinct presentation of jurisprudence as a formal source of law adjusted to syllogistic development according to particular cases.
