Abstract

La presente investigación se ocupa de estudiar el tema de la responsabilidad extracontractual del Estado por omisión en la expedición de leyes en Colombia, tema que apenas comienza a ser desarrollado por la doctrina y por la jurisprudencia nacional. El tema objeto de estudio, desde el punto de vista constitucional en cuanto a la omisión legislativa, ha sido ampliamente estudiado por la Jurisprudencia Constitucional colombiana, la que desde el año 1996, a partir de las sentencias en sede de exequibilidad, construyó la postura que permanece vigente aún en la actualidad y cuya característica primordial, es la de aceptar la existencia de la omisión legislativa relativa (por vía de su declaratoria de inconstitucionalidad), mas no así de la omisión legislativa absoluta (Sentencia C-543 de 1996) frente a la cual el Tribunal Constitucional colombiano se ha declarado inhibido para estudiarla; ahora bien, la omisión legislativa como fuente de responsabilidad extracontractual del Estado, tema de competencia de la Jurisdicción Administrativa, ha tenido un estudio precario, ya que son escasas las sentencias que se han ocupado de estudiar este fenómeno jurídico. El principal objetivo planteado al inicio de la investigación, era determinar si era viable que con ocasión de una omisión legislativa, surgiera para el Estado la obligación de reparar los posibles daños antijurídicos que con ella se pudieran producir y en caso de encontrar factible esa posibilidad, establecer el título de imputación dentro del cual se podría configurar este tipo de responsabilidad; al respecto, la investigación arrojó Como 16 resultado, la efectiva procedencia de este tipo de responsabilidad (tan sólo con respecto a la omisión legislativa relativa) y, específicamente bajo el título de imputación de daño especial. Para la realización del presente trabajo, se acudió al estudio de los trabajos de doctrinantes, tanto nacionales como extranjeros, e igualmente al análisis de la jurisprudencia de las Cortes Constitucional, Suprema de Justicia y Consejo de Estado, en los diferentes aspectos que integran la responsabilidad estatal por omisión en la expedición de leyes. La importancia de la investigación, radica en que al final de la misma, se presenta una propuesta de estructuración de la responsabilidad pública alquiliana, con base específicamente en la omisión legislativa relativa, indicando el título de imputación procedente, sus elementos configuradores y la forma en que debe ser entendida por los Jueces Administrativos.

The present investigation deals with the study of the non-contractual liability of the State by omission in the issuance of laws in Colombia, a topic that is only beginning to be developed by the doctrine and by national jurisprudence. The subject under study, from the constitutional point of view regarding the legislative omission, has been widely studied by the Colombian Constitutional Jurisprudence, which since 1996, from the judgments in the seat of constitutionality, built the position that It remains in force even at present and whose main characteristic is to accept the existence of the relative legislative omission (through its declaration of unconstitutionality), but not of the absolute legislative omission (Sentence C-543 of 1996). which the Colombian Constitutional Court has declared itself inhibited to study it; However, the legislative omission as a source of extracontractual responsibility of the State, a matter of competence of the Administrative Jurisdiction, has had a precarious study, since there are few judgments that have dealt with studying this legal phenomenon. The main objective set at the beginning of the investigation was to determine if it was feasible that, on the occasion of a legislative omission, the State should be obliged to repair the possible unlawful damages that could occur with it and, if that possibility were found feasible, establish the imputation title within which this type of responsibility could be configured; In this regard, the investigation yielded, as a result, the actual origin of this type of responsibility (only with respect to the relative legislative omission) and, specifically, under the title of imputation of special damage. For the realization of this work, we went to the study of the works of doctrinants, both national and foreign, and also to the analysis of the jurisprudence of the Constitutional Courts, Supreme Court and State Council, in the different aspects that make up the responsibility state by default in the issuance of laws. The importance of the research lies in the fact that at the end of it, a proposal for the structuring of the public liability of Almería is presented, based specifically on the relative legislative omission, indicating the title of the appropriate imputation, its configurating elements and the way that must be understood by the Administrative Judges.
