The unconstitutional state of affairs as protection of the fundamental right to education in public educational policies

Abstract

El presente artículo tiene como objetivo analizar la forma en que el estado de cosas inconstitucional implica la protección del derecho fundamental a la educación en las políticas públicas educativas en el derecho de Perú y Colombia. Para desarrollar la investigación, se adopta en la metodología un enfoque cualitativo con diseño de teoría fundamentada, con la técnica del análisis documental y el instrumento de guía de análisis documental. Se concluye que el estado de cosas constitucional es un mecanismo clave para la protección estructural de derechos, especialmente cuando existen violaciones masivas y persistentes, y su aplicación permite corregir las deficiencias estructurales y garantizar la responsabilidad del Estado en salvaguarda de los derechos fundamentales, como la educación. La intervención estatal debe garantizar condiciones adecuadas para todos, priorizar a los grupos vulnerables y promover políticas que eliminen barreras estructurales con el objetivo de lograr una educación inclusiva y de calidad.

O presente artigo tem como objetivo analisar de que forma o estado de coisas inconstitucional implica a proteção do direito fundamental à educação nas políticas públicas educacionais no direito do Peru e da Colômbia. Para o desenvolvimento da pesquisa, adota-se na metodologia uma abordagem qualitativa com delineamento de teoria fundamentada, utilizando a técnica de análise documental e o instrumento guia de análise documental. Conclui-se que o estado de coisas inconstitucional constitui um mecanismo fundamental para a proteção estrutural de direitos, especialmente quando há violações massivas e persistentes, e que sua aplicação permite corrigir deficiências estruturais e garantir a responsabilidade do Estado na salvaguarda de direitos fundamentais, como à educação; e a intervenção estatal deve garantir condições adequadas para todos, priorizar grupos em situação de vulnerabilidade e promover políticas que eliminem barreiras estruturais, com o objetivo de alcançar uma educação inclusiva e de qualidade.

The purpose of this article is to analyze how the Unconstitutional State of Affairs (USA) operates as a mechanism for protecting the fundamental right to education within public educational policy in the law of Peru and Colombia. The study adopts a qualitative methodology with a grounded theory design, using the documentary analysis technique and the documentary analysis guide instrument. The findings indicate that the Unconstitutional State of Affairs is a key tool for the structural protection of rights, particularly in contexts of massive and persistent violations. Its application enables the correction of structural deficiencies and reinforces the State’s responsibility in safeguarding fundamental rights such as education. Moreover, effective state intervention must ensure adequate conditions for all, prioritize vulnerable groups, and promote policies aimed at eliminating structural barriers to achieve inclusive and high-quality education.
