National Margin of Appreciation. The Apparent Conflict with Conventionality Control

Abstract

This work aims to reconcile the apparent contradiction between the doctrine of the national margin of appreciation and the increasing impact of pronouncements by the Inter-American Court of Human Rights through the construction of the notions of “margin of appreciation within the conventionality control” and “margin of appreciation post-sanction”. Both clearly differentiated moments delineate spaces of discretion and respective controls between the States and the Inter-American Court. To give content to these notions, the characteristics of the Inter-American human rights protection system and its expansive process in recent decades will be analyzed. The concept of the national margin of appreciation will be examined in a comparative perspective, considering both the doctrine and jurisprudence of the European Court of Human Rights and the Inter-American Court of Human Rights, highlighting their similarities and differences. Finally, reflection will be made on the two proposed notions in which a margin of appreciation in favor of the States could be enabled.

El presente trabajo pretende articular la aparente contradicción entre la doctrina del margen de apreciación nacional y la incidencia creciente de los pronunciamientos de la Corte Interamericana de Derechos Humanos por medio de la construcción de las nociones del margen de apreciación intra control de convencionalidad y del margen de apreciación post sanción. Ambos momentos bien diferenciados delimitan espacios de discrecionalidad y controles respectivos entre los Estados y la Corte IDH. Para dar contenido a estas nociones, se analizarán las características del sistema de protección interamericano y su proceso expansivo en las últimas décadas. Se profundizará en el concepto del margen de apreciación nacional en una mirada comparada tanto de la doctrina como de la jurisprudencia del Tribunal Europeo de Derechos Humanos y de la Corte IDH, señalando sus similitudes y diferencias. Finalmente, se reflexionará sobre las dos nociones propuestas en las que se podría habilitar un margen de apreciación en favor de los Estados.

Este trabalho busca articular a aparente contradição entre a doutrina da margem de apreciação nacional e a crescente incidência dos pronunciamentos da Corte Interamericana de Direitos Humanos (CIDH) por meio da construção das noções de margem de apreciação dentro do controle de convencionalidade e margem de apreciação pós-sanção. Ambos momentos claramente diferenciados delimitam espaços de discricionariedade e respectivos controles entre os Estados e a CIDH. Para dar conteúdo a essas noções, serão analisadas as características do sistema de proteção interamericano e sua expansão nas últimas décadas. O conceito de margem de apreciação nacional será examinado em profundidade em uma análise comparativa tanto da doutrina quanto da jurisprudência da Corte Europeia de Direitos Humanos e da CIDH, apontando suas semelhanças e diferenças. Por fim, será feita uma reflexão sobre as duas noções propostas em que uma margem de apreciação poderia ser concedida aos Estados.
