Abuso del derecho de información

Abstract

Esta exposición toma como base una sentencia de la Suprema Corte de Justicia, cuyo fundamento resulta esclarecedor acerca de los límites del derecho a la información.Este derecho constitucional a expresarse libremente, garantizado por la ausencia de censura previa, colide a menudo con elderecho de los ciudadanos a ser protegidos en su honor, también consagrado en la Constitución. Ante un conflicto entre dos derechos, no se trata de armonizarlos sino de privilegiar aquel de mayor jerarquía, sostiene el autor. Y en este caso, se trata de establecer si debe prevalecer un derecho individual o un derecho social. La Constitución es muy clara al respecto: los derechos individualesprevalecen, para garantizar que la persona no pueda ser objeto de ningún fin, y losderechos sociales deben ser respetados en tanto no amenacen a la persona, que esla base del sistema. Al ejercer su derecho a informar, los autores e impresores sonresponsables por los abusos que pudieran cometer. Y los ciudadanos tienen derechoa exigir esta responsabilidad sin que ello signifique ningún tipo de exceso.
