Abstract. This paper aims to look into the current situation of the constitutionality controlin the Republic of Argentina. It is for that purpose that classic hermeneutic canons on thesubject are reviewed, so as to reflect on the changes that have taken place in these positionsas from the end of the last century and beginning of the 21st century. In the last few years, the criteria that consider the Argentinean Supreme Court a constitutional court without therebeing a specific amendment have become stronger, co-existing with the traditional diffusesystem.
Resumen. El presente trabajo procura indagar la actualidad del control de constitucionalidaden la República Argentina. Para ello, pasa revista a los clásicos cánones hermenéuticosexistentes en la materia, para luego reflexionar sobre los cambios operados en esasposturas a partir de fines del siglo pasado y comienzos del siglo XXI. Se han profundizadoen los últimos tiempos los criterios que apuntarían informalmente a considerar a la CorteSuprema argentina como tribunal constitucional, sin reforma expresa, en coexistencia conel tradicional sistema difuso.
