Suverenitet over ressursene i havområdene rundt Svalbard.

Abstract

Norges suverenitet over Svalbard ble anerkjent i 1920 gjennom Svalbardtraktaten, fremforhandlet under Paris-konferansen i kjølvannet av 1. verdenskrig. På dette tidspunktet avgjorde stormaktene og andre interesserte stater at anerkjennelsen var den mest praktiske løsningen for å forvalte ressursene på Svalbard og i farvannene rundt. Samtidig var løsningen et kompromiss der Norge ikke fikk enerett til ressursene i området. På den tiden strakk kyststatenes suverenitet over sjøterritorier seg neppe lengre enn fire nautiske mil fra grunnlinjen. De neste 100 års rivende utvikling i både teknologi, og internasjonal rett muliggjorde ressursutnyttelse langt til havs, hvis omfang var neppe forespeilet i 1920. Spørsmålet er blant annet om forpliktelser Norge har etter Svalbardtraktaten er en slik be-grensning av suvereniteten over øygruppen at også sjøterritorier som utledes av suvereniteten skal ha det samme regimet som på Svalbard. Den viktigste komponenten i dette regimet er noe som i dag kalles likebehandlingsprinsippet – at traktatparter ikke skal forskjellsbehandles. Spørsmålet henger sammen med hvor langt ut til havs fra Svalbards grunnlinje dette regimet skal gjelde, og hvilke ressurser i havet traktaten omfatter.
