Kroppsvisitasjon av fanger

Abstract

Fengselsstraff kjennetegnes ved sterk innskrenkning i bevegelsesfriheten sammenlignet med bevegelsesfriheten for samfunnets øvre medlemmer. Som fange er man i tillegg undergitt en rekke sikkerhetstiltak i form av brev- og besøkskontroll, bruk av tvangsmidler, narkotikakontroller, isolering og kontroll i form av undersøkelser. Hovedproblemstillingen som drøftes i denne oppgaven er om dagens regulering og praktisering av kroppsvisitasjon etter straffegjennomføringsloven (strgjfl.) § 28 er forenlig med Grunnloven (Grl.) og Den europeiske Menneskerettighetskonvensjon (EMK). Oppgaven vil særlig gå i dybden når det gjelder denne problemstillingen. Den andre problemstillingen er hvilke rettssikkerhetsgarantier kroppsvisitasjon er underlagt i form av kontroll og tilsyn. Den tredje problemstillingen er hva som er de rettslige virkningene av ulovlig kroppsvisitasjon. Fokuset vil være på rettslige virkninger av krenkelse av Grl. § 93 (2) og EMK art. 3. Oppgaven vil også redegjøre for hva som innebærer et «effektivt rettsmiddel» etter EMK art. 13.
