Arbeidstakeres rettslige vern mot høy arbeidsintensitet

Abstract

Høy arbeidsintensitet brukes her som en fellesbetegnelse for høyt tidspress og helsebelastende arbeidstidsordninger. Når det gjelder tidspress, konkluderer jeg med at arbeidsmiljølovens krav til arbeidsmiljøet i all hovedsak gir arbeidstakerne et godt vern. En svakhet ved reglene er at tidspress, i motsetning til enkelte andre psykososiale arbeidsmiljøfaktorer, ikke er eksplisitt regulert i loven. Hvorvidt internkontrollreglene bidrar til å styrke rettsvernet, avhenger av hvordan de blir praktisert. Når det gjelder arbeidstid, konkluderer jeg med at arbeidsmiljølovens maksimalregler om arbeidstidens lengde gir et tilstrekkelig vern dersom arbeidsgiver foretar den forsvarlighetsvurderingen som loven krever. Reglene som skal ivareta arbeidstakernes behov for søvn og hvile er imidlertid mer problematiske. Slik jeg ser det er adgangen til å inngå avtale om springskift for vid, og særlig ved nattarbeid gi ikke lovens regler om pauser i arbeidstiden et godt nok vern.
