Passiv medvirkning

Abstract

Det rettslige spørsmålet er om, og hva som skal til for at noen kan straffes for medvirkning når de har utøvd liten eller ingen aktivitet i forhold til et straffbart forhold begått av noen andre. Oppgaven går inn på de generelle vilkårene for medvirkningsansvar, samt de spesielle vilkår som gjelder for passiv medvirkning. Herunder hva som kreves for å statuere en handleplikt for medvirkeren; spørsmålet om positiv tilskyndelse, et særlig tilknytningsforhold og et handlingsalternativ. Videre behandles handlepliktens rekkevidde.
