Abstract

Avhandlingen tar for seg innsattes rett til privat- og familieliv etter Den europeiske menneskerettskonvensjon (EMK) art. 8. Ettersom fengslingen nødvendigvis vil innebære innskrenkninger i innsattes frihet, blir utgangspunktet for fengslede sånn sett et annet sammenlignet med de fleste andre rettighetssubjekter etter den aktuelle bestemmelsen. Fremstillingen vil se hen til domspraksis fra Den europeiske menneskerettsdomstol (EMD). Sentralt i denne forbindelse står spørsmålet om i hvilken grad EMD verner om innsattes rettigheter etter art. 8, og herunder hvilke utslag de spesielle omstendigheter ved fengslingssituasjonen eventuelt gir i praksis. Det er særlig nødvendighetskravet etter annet ledd som har vist seg å være interessant for hvordan Domstolen mer konkret anvender bestemmelsen på innsattes forhold.
