La custodia compartida, basada en la corresponsabilidad parental, se incorpora a través de la Ley 15/2005 en el Código Civil. En la redacción del texto civil esta figura tiene un carácter excepcional. Sin embargo, las diferentes legislaciones autonómicas y la jurisprudencia en esta materia consideran la custodia compartida como la medida más beneficiosa para el interés del menor. El presente estudio se va a centrar en la evolución de la custodia compartida en España, tanto en el plano legislativo como jurisprudencial, delimitando cuáles son las ventajas y desventajas de esta figura. The joint custody, based on parental co-responsibility, is incorporated through Law 15/2005 in the Civil Code. In the civil wording, this kind of custody has an exceptional character. However, the different regional laws and the jurisprudence in this matter consider joint custody as the most beneficial measure for the interest of the child. The present study will focus on the evolution of joint custody in Spain, both in the legislative and jurisprudential, defining what are the advantages and disadvantages of this measure.
