Abstract

En este estudio se expondrán algunas de las razones que existen a favor y en contra del uso del sexo en la tarificación de riesgos en los seguros, y nos detendremos en el contenido de la Ley Orgánica 3/2007 para la igualdad efectiva de mujeres y hombres, que dedica su Título VI (arts. 69-72) a la Igualdad de trato en el acceso de bienes y servicios y su suministro, con especial referencia a los seguros. Por último se comprobará como el esperado desarrollo reglamentario de la Ley, a través del RD 1361/2007 que modifica varios artículos del Reglamento de Ordenación y Supervisión de los Seguros Privados, prevé supuestos excepcionales de diferenciación sexual de primas y prestaciones por sexo que dejan muy en entredicho la pretendida homogeneidad en materia de sexo en la contratación de determinados seguros. El origen de este trabajo tiene su origen en mi participación en el Seminario y Foro de Debate Interdisciplinar titulado Diagnóstico del principio de libertad efectiva en la esfera de lo privado, organizado por el Departamento de Derecho Privado de la Universidad de Almería y subvencionado por el Ministerio de Trabajo y Asuntos Sociales (Instituto de la Mujer), el 11 de abril de 2008. Por el público no especializado al se dirigía el seminario (alumnos de Derecho de la Universidad de Almería) opté por usar en la exposición del tema un estilo distinto al habitual, digamos más desenfadado. Aunque para su publicación he revisado con cierta profundidad el contenido de aquella charla, no he querido abandonar la filosofía del trabajo original.
