Abstract

El creciente interés social y mediático por los escándalos del Rey Emérito, Juan Carlos I, nos lleva a analizar la figura constitucional de la inviolabilidad real. Para ello, se partirá desde una perspectiva comparada, analizando supuestos como el impeachment estadounidense o la regulación internacional relativa a la responsabilidad de los Jefes de Estado. A modo de concretar el alcance e importancia de la inviolabilidad real en el ordenamiento jurídico español, se analizará tanto la evolución constitucional hasta el momento como el proceso constituyente y la concepción de la inviolabilidad y la Jefatura de Estado monárquica en la Constitución de 1978. Por último, abordaremos las cuestiones relativas a los actos controvertidos del monarca emérito y el reflejo jurisprudencial y doctrinal que estos actos presentan. The growing social and media interest in the scandals of the King Emeritus, Juan Carlos I, leads us to analyse the constitutional figure of royal inviolability. To do so, we will start from a comparative perspective, analysing cases such as impeachment in the United States or international regulations on the responsibility of Heads of State. In order to specify the scope and importance of royal inviolability in the Spanish legal system, we will analyse both the constitutional evolution to date and the constituent process and the conception of inviolability and the monarchical Head of State in the 1978 Constitution. Finally, we will address the issues relating to the controversial acts of the emeritus monarch and the jurisprudential and doctrinal reflection of these acts.
