Abstract

El objeto del presente trabajo es analizar la naturaleza, regulación y consolidación de estas nuevas fórmulas y vías de contratación -especialmente la figura contractual de la vivienda vacacional o con fines turísticos- que se enmarcan dentro de la llamada Economía colaborativa, verdadera revolución del sector turístico en el mercado global, y no pequeña competidora de los tradicionales y reglados cauces del alojamiento turístico (hoteles, hostales y albergues, entre otros), así como su diferenciación con otras figuras afines y las consecuencias sociales, problemática y críticas que suscitan. La metodología empleada para abordar cada una de estas cuestiones ha consistido, fundamentalmente, en el análisis de fuentes normativas -a nivel comunitario, estatal y autonómico- y jurisprudenciales, así como en la consulta de una amplia bibliografía y recursos web de las Instituciones competentes en materia turística.

En el presente trabajo se realiza un análisis del fenómeno de la vivienda vacacional, novedosa modalidad de alojamiento extrahotelero que en los últimos años está alcanzando un gran éxito, así como suscita críticas en distintos ámbitos. In thisfinal degreep project we make an analysis of the vacation home phenomenon, an innomative modality of non-hotel accommodation that in recent years is achieving a great suc- cess, as well as arouses criticism in different areas.
