El marco internacional del régimen de patentes, y particularmente el acuerdo TRIP o ADPIC, establece una serie de estándares destinados a implementar un mínimo de protección, en cada país, respecto de las invenciones patentables. Igual que el régimen de patentes busca evitar el aprovechamiento gratuito del esfuerzo ajeno, particularmente por parte de quien copia o utiliza invenciones ajenas, el régimen internacional de patentes busca impedir que ciertos países puedan aprovechar el esfuerzo inventivo incentivado por los regímenes de patentes de otros, permitiendo la utilización gratuita en su territorio de invenciones ajenas.
