El animal: un sujeto de derechos no humanos

Abstract

En los últimos años, han surgido grandes cambios sobre la construcción del concepto de “animales” dentro del ordenamiento jurídico colombiano. En este marco, la presente investigación tiene como finalidad analizar la evolución jurídica del concepto de “animales”. Para el desarrollo de este artículo, primero, se construye el estado del arte basado en una línea de tiempo con las fuentes del Derecho internacionales y nacionales, con el objeto de evidenciar la transformación jurídica en torno a la protección de estos seres sintientes. Luego, se explican los modelos de relación humano-animal con el fin de determinar las posiciones que la doctrina ha diseñado. Por último, se exponen argumentos sobre porqué se debería considerar como sujetos de derechos a los animales. En consecuencia, el resultado que se obtiene es que, a medida que pasa el tiempo, se prorroga la inclinación de considerar a los animales como titulares de derechos, en razón a que la sociedad y las instituciones vienen adoptando modelos de relación humano-animal innovadores dentro de la realidad actual, los cuales niegan que los animales sean clasificados como meros objetos del derecho y, en su lugar, plantean la teoría de estudiar al animal como dentro de un ecosistema y ambiente, generando así, una serie de consecuencias jurídicas particulares.
