Abstract

Con la figura de los jueces constitucionales estamos hablando no de un caballo de Troya para afirmar la dictadura universal de los derechos, sino de un instrumento para entender nuestras propias constituciones nacionales. En la medida en que ha transcurrido la evolución de las constituciones vemos cómo, en el caso de Colombia, entre la generación constituyente y las sucesivas se instituye una relación como la que existe entre padres (los “padres fundadores”) e hijos sucesores. A cada generación de herederos le corresponde “mejorar y perpetuar”, no echar al viento, el legado recibido. Las decisiones de 5 contra 4 o, en la Corte Constitucional italiana, de 8 contra 7, dejan siempre un sentimiento de insatisfacción, como el que se tiene frente a un deber no cumplido a plenitud. Con este tipo de decisiones las cortes constitucionales se exponen a la crítica política, o sea a la de haber actuado arbitrariamente como pequeños parlamentos.

With the figure of constitutional justices we are not talking about a Trojan horse to state the universal rights dictatorship, but about an instrument for understanding our own national constitutions. As these latter have been evolving, we see that in the Colombian case between the constituent offspring and the following ones arises a relationship as the one between parents (“founding parents”) and successor children. Each heir’s offspring has the responsibility of “improving and perpetuating”not throwing caution to the winds— the received legacy. Decisions of 5 to 4 or, in the Italian Constitutional Court of 8 to 7, always leave a dissatisfaction feeling as that of not totally accomplished duty. With these types of decisions, constitutional courts are exposed to political critic, which means having arbitrary conducted as little parliaments.
