El hurto en Derecho visigodo

Abstract

EL objeto del presente trabajo, no es otro que determinar tanto los orígenes como el contenido de la regulación que la Lex Wisigothorum contiene acerca del hurto. Tras el estudio de las fuentes tanto visigodas como romanas, pueden extraerse las siguientes conclusiones con carácter general. En primer lugar, a la hora de construir el tipo penal, el legislador visigodo toma como modelo básico al Derecho Romano. Esta afirmacion se sustenta en el, a menudo evidente, uso de las fuentes e instituciones romanas. En segundo lugar, a pesar de esta afirmación, para la época de promulgación de la Lex Wisigothorum, es claro que el Derecho Visigodo, al menos en lo que a la institución del furtum respecta, adquiere una madurez suficiente como para poder considerarlo un fenómeno autonómo, influido, sí, por el precedente romano, más con personalidad propia. El trabajo finaliza con una comparativa con las demás Leges Barbarorum, sin que pueda concluirse la existencia de un elemento germánico común claro, así como con un apartado dedicado a las conclusiones generales.
