In the context of the principle of free will, all legally constituted couples can choose the economic regime that will govern their property (Spanish Civil Code, s. 1255). Nevertheless, only those autonomous communities with jurisdiction over civil matters can develop legislation regarding the property regime applicable to legally constituted couples, provided they respect the limitations that section 149.1.8 of Spanish Constitution imposes on the development of their own civil law, and, provided also that such legislation does not go against the principle of free development of personality (Spanish Constitution s. 10.1). The legal conflict arises when the legislation of the autonomous communities allow legally constituted couples to adhere, in bulk, to the matrimonial property regimes regulated for the spouses in the Civil Code, such as the gananciales regime, and, in addition, the couple intend for the effects of said regime to be registered in a civil registry (effective against third parties).
En el marco del principio de la autonomía de la voluntad, todas las parejas legales pueden escoger el régimen económico patrimonial por el que se va a regir su unión (art. 1255 CC). No obstante, solo las comunidades autónomas con competencia en materia de legislación civil tienen legitimidad para regular el régimen económico aplicable a la pareja, siempre y cuando respeten las limitaciones impuestas por el artículo 149.1.8ª CE al desarrollo del Derecho Civil propio, y mediante dicha regulación no se conculque el libre desarrollo de la personalidad (art. 10. 1 CE). El conflicto jurídico emerge cuando estas legislaciones civiles autonómicas permiten a las parejas legales acogerse, en bloque, a los regímenes económicos matrimoniales que el Código Civil regula para los cónyuges —tales como el régimen económico de gananciales— y, además, los miembros de la pareja pretenden que los efectos de dicho régimen accedan a un registro de naturaleza civil (con eficacia frente a terceros).
