La vecindad civil y los conflictos intertemporales en la Ley de Derecho civil vasco

Abstract

El trabajo pone de manifiesto las complicaciones prácticas producidas por la coexistencia material y temporal de los instrumentos en presencia y ello se refleja a través de pronunciamientos emanados de los tribunales y de la Dirección General de Registros y del Notariado. Bajo estas decisiones subyacen cuestiones ya clásicas del Derecho Internacional privado pero que no están resueltas por su extrema complejidad; como la competencia Estado /CCAA en materia de Derecho Interregional que se remueve con la ampliación del ámbito de aplicación territorial, subjetivo y personal de la ley vasca y que nos vuelve a interpelar a la necesidad de acotar los límites del desarrollo normativo de las Comunidades Autónomas en materia de Derecho civil; o cuestiones teóricas como el conflicto móvil o los problemas de calificación a los que intenta darse una solución de manera dogmática. Todo ello desde una visión crítica que nos lleva a insistir en la necesaria promulgación de una Ley estatal especifica de conflictos de leyes internos que haga frente a las insuficiencias del sistema.
