Abstract

[ES] En la actualidad, Internet es la principal fuente de información y publicidad. Ha contribuido a crear grandes avances, pero también ha generado muchos problemas. Uno de estos problemas surge cuando los padres de un menor comparten fotografías en las redes sociales, vulnerando los derechos al honor, a la intimidad personal y familiar y a la imagen. Esta práctica, también conocida como sharenting, contribuye a crear la identidad y huella digitales del menor, que nunca podrá ser eliminada. En este trabajo se profundiza en los problemas actuales del sharenting y en sus choques con los derechos de identidad de los menores. Asimismo, es importante analizar los límites de la patria potestad cuando esta información se publica en las redes sociales y observar cuando un menor tiene suficiente madurez para permitir que sus progenitores publiquen sus fotografías. En la legislación española, los menores están protegidos por el concepto de ‘interés superior del menor’, pero ¿hasta qué punto el sharenting no vulnera esos derechos?

[EU] Gaur egun, Internet da informazio eta publizitate iturri nagusia. Aurrerapen izugarriak sortzen lagundu du, baina arazo asko ere sortu ditu. Arazo horietako bat adingabeko baten gurasoek sare sozialetan argazkiak partekatzen dituztenean sortzen da, ohore, norberaren eta familiaren intimitate eta irudi eskubideak urratuz. Sharenting izenarekin ere ezaguna den praktika honek adingabearen nortasun digitala eta aztarna digitala sortzen laguntzen du, inoiz ezabatu ezin izango dena. Lan honetan, sharenting-aren egungo arazoak sakon aztertuko dira, baita adingabeen nortasun eskubideekin dituen talkak ere. Era berean, garrantzitsua da guraso-ahalaren mugak aztertzea informazio hori sare sozialetan argitaratzen denean, eta ikusi beharko da adingabe batek noiz duen heldutasun nahikoa bere gurasoek argazkiak argitaratzen dutenean baimena emateko. Espainiako legerian, adingabeak ‘adingabearen interes gorenaren’ kontzeptuarekin babestuta daude, baina, zenbateraino ez ditu sharentingak eskubide horiek urratzen?

[EN] Today, the Internet is the main source of information and advertising. It has helped to create great advances, but it has also generated many problems. One of these problems arises when a child's parents share photographs on social networks, infringing the rights to honour, personal and family privacy and image. This practice, also known as sharenting, contributes to creating the child's identity and digital footprint, which can never be deleted. This document examines the current problems of sharenting and its clashes with the identity rights of minors. It is also important to analyse the limits of parental authority when this information is published on social networks and to observe when a minor is mature enough to allow his or her parents to publish his or her photographs. In Spanish law, minors are protected by the concept of ‘best interests of the minor’, but to what extent does sharenting not violate these rights?
