Abstract

[ES] El objetivo de este trabajo es realizar un análisis de la responsabilidad de las administraciones públicas para luego estudiar más profundamente la responsabilidad patrimonial existente en el marco sanitario. Para ello se atiende a la evolución histórica dentro de la doctrina jurisprudencial, al daño como presupuesto general para que exista responsabilidad y a la relación de causalidad que debe existir entre la lesión y quien produce el daño. Así mismo se explica la acción de responsabilidad, plazos y procedimiento por medio de la cual la persona afectada podrá exigir responsabilidad a la Administración. En lo relativo a la responsabilidad sanitaria se expone el concepto de lex artis, la importancia del consentimiento informado, de la pérdida de oportunidad, del daño desproporcionado y del normal o anormal funcionamiento de la administración a la hora de ejercitar la acción de exigir responsabilidad.

[EN] The aim of this study is to carry out an analysis of the responsibility of public administrations in order to study more deeply the existing patrimonial responsibility in the health framework. Attention is paid to the historical evolution within the jurisprudential doctrine, to damage as a general presupposition for responsibility to exist and to the causal relationship that must exist between the injury and who causes the damage. It also explains the responsibility action, deadlines and procedure by means of which the affected person may demand responsibility from the Administration. With regard to health liability, the concept of lex artis, the importance of informed consent, loss of opportunity, disproportionate damage and the normal or abnormal functioning of the administration when exercising the action to demand responsibility is exposed.
