Fundamentación y desafíos de la responsabilidad penal de los menores: nuevas ciencias y delincuentes juveniles

Abstract

[ES] La cuestión sobre la responsabilidad penal del menor ha sido, es y seguirá siendo cuestión objeto de debate. El novedoso paradigma establecido a través del vigente Código Penal y la Ley del Menor dio respuesta a debates que históricamente venían sucediéndose, pero crearon a su vez nuevos a los que otorgar respuesta. Así, se centra este estudio en resolver sobre la naturaleza de este nuevo sistema, estudiando su fundamentación y resolviendo sobre la existencia o no de un fenómeno desnaturalizador del mismo. A su vez, y con miras al futuro, se recogen las más recientes aportaciones que las nuevas ciencias brindan con relación a los denominados “jóvenes”, meditando sobre el encaje de estas contribuciones en el sistema y resolviendo sobre las limitaciones de dichas investigaciones.

[EN] The question of the criminal responsibility of minors has been, is and will continue to be a matter of debate. The new paradigm established through the current Penal Code and the Law on Minors provided a response to debates that had been going on historically, but at the same time created new ones to which a response had to be given. Thus, this study focuses on resolving the nature of this new system, studying its foundations and resolving whether or not a denaturalising phenomenon exists. At the same time, and with a view to the future, the most recent contributions made by the new sciences in relation to the so-called "young people" are collected, meditating on how these contributions fit into the system and resolving the limitations of this researches.

[EU] Adingabearen erantzukizun penala eztabaidagai izan da, da eta jarraituko du izaten. Indarrean dagoen Zigor Kodearen eta Adingabearen Legearen bidez ezarritako paradigma berritzaileak historikoki gertatzen ari ziren eztabaidei erantzun eman zien, baina, aldi berean, berriak sortu zituzten. Horrela, azterketa honek, sistema berri honen izaerari buruz ebaztean zentratzen da, bere oinarritzea aztertuz eta sistema desnaturalizatzen duen fenomeno bat dagoen ala ez erantzuten. Era berean, etorkizunari begira, zientzia berriek "gazte" deiturikoei buruz egiten dituzten ekarpen berrienak biltzen dira, ekarpen horiek sisteman nola txertatzen diren hausnartuz eta ikerketa horien mugak azalduz.
