La perspectiva de género en la interpretación de las normas del Derecho del Trabajo y la Seguridad Social

Abstract

[ES] El presente trabajo pone en manifiesto la importancia de la integración de la perspectiva de género en la interpretación y aplicación del derecho, especialmente en el ámbito del derecho del trabajo y la seguridad social, aportando criterios interpretativos para ese fin. No solo es necesario un cuerpo normativo que abarque la perspectiva de género, sino profesionales que alberguen la capacidad de enjuiciar de acuerdo con los parámetros de esta. Desde esta premisa, se busca adaptar las interpretaciones de las normas al contexto social, teniendo en cuenta que en este se entrelazan multitud de factores que impiden la igualdad y favorecen a la discriminación de las mujeres, creando obstáculos para alcanzar estatus paritarios respecto de los varones.

[EU] Lan honek zuzenbidea interpretatzean eta aplikatzean genero-ikuspegia txertatzearen garrantzia frogatzen du, batez ere lanaren eta gizarte-segurantzaren zuzenbidearen eremuan, eta interpretazio-irizpideak emanez. Beharrezkoa da, alde batetik, generoperspektiba hartzen duen araudi bat, eta, bestetik, araudi horren arabera epaitzeko gaitasuna duten profesionalak existitzea. Premisa horretatik abiatuta, interpretazioak gizarte-testuingurura egokitu behar dira, kontuan hartuta testuinguru horretan berdintasuna eragozten duten eta emakumeen diskriminazioari mesede egiten dioten alderdi ugari elkartzen direla, gizonekiko estatus paritarioa lortzeko oztopoak sortuz.

[EN] This project highlights the importance of integrating gender perspective in the interpretation and application of Law, especially in the field of labor law, providing interpretive criteria to achieve its inclusion. Not only is a regulatory framework that encompasses the gender perspective needed, but also professionals who have the capacity to prosecute according to its parameters. From this premise, we seek to adapt the interpretations of the norms to the social context, taking into account that a multitude of factors are intertwined and prevent equality and favor discrimination against women, creating obstacles to achieving equal status regarding men.
