[ES] La instauración del doble grado de jurisdicción en las sanciones administrativas ha generado un amplio debate en el ámbito jurídico, tanto a nivel nacional como internacional. Este tema ha suscitado un considerable interés por parte de organismos judiciales supranacionales. Un caso especialmente destacado es el de Saquetti Iglesias contra España, en el cual el Tribunal Europeo de Derechos Humanos emitió importantes directrices para los tribunales españoles. Este tribunal ha enfatizado la importancia de garantizar el derecho a un segundo juicio en casos de sanciones administrativas, considerándolo como un elemento esencial para salvaguardar los derechos humanos y la equidad procesal. En este contexto, tanto la jurisprudencia como la legislación internacionales, incluyendo el artículo 2 del Protocolo 7 del Convenio Europeo de Derechos Humanos, han establecido criterios claros sobre la necesidad de la doble instancia en el ámbito administrativo sancionador. Mencionaremos también la Ley Orgánica 7/2015, de 21 de julio, y el requisito del interés casacional objetivo.
[EN] The establishment of double jurisdiction in administrative sanctions has sparked extensive debate in the legal sphere, both nationally and internationally. This topic has garnered significant interest from supranational judicial bodies. A particularly notable case is that of Saquetti Iglesias against Spain, in which the European Court of Human Rights issued important guidelines for Spanish courts. This court has emphasized the importance of ensuring the right to a second trial in cases of administrative sanctions, considering it as an essential element to safeguard human rights and procedural fairness. In this context, both international jurisprudence and legislation, including Article 2 of Protocol 7 of the European Convention on Human Rights, have established clear criteria on the necessity of double instance in the field of administrative sanctioning. We will also mention Organic Law 7/2015, of July 21, and the requirement of objective cassation interest.
[EU] Administrazio-zehapenetan jurisdikzio bikoitza ezartzeak eztabaida handia sortu du arlo juridikoan, bai Espainian bai nazioartean. Gai horrek nazioz gaindiko organo judizialen interes nabarmena piztu du. Bereziki aipagarria da Saquetti Iglesias Espainiaren aurka, non Giza Eskubideen Europako Auzitegiak jarraibide garrantzitsuak eman baitzituen Espainiako auzitegietarako. Administrazio zehapenen kasuetan bigarren judiziorako eskubidea bermatzearen garrantzia nabarmendu du epaimahaiak, eta funtsezko elementutzat hartu du giza eskubideak eta ekitate prozesala babesteko. Testuinguru horretan, bai nazioarteko jurisprudentziak, bai legediak, Giza Eskubideen Europako Hitzarmenaren 7. Protokoloaren 2. artikulua barne, irizpide argiak ezarri dituzte administrazio-zehapenaren esparruan bi instantziaren beharrari buruz. Uztailaren 21eko 7/2015 Lege Organikoa eta kasazioko interes objektiboaren baldintza ere aipatuko ditugu.
