[ES] En el presente trabajo se aborda el papel del Banco Central Europeo (BCE) dentro de la Unión Europea (UE) como institución clave en la formulación y ejecución de la política monetaria en la eurozona. El análisis se centra en cómo la estructura organizativa y funcional del BCE y del Sistema Europeo de Bancos Centrales (SEBC) plantea desafíos para garantizar su legitimidad democrática dentro del marco del modelo de Democracia constitucional predominante en la UE. Se hará especial alusión a su independencia, otorgada por las leyes, en la búsqueda de su principal objetivo: la estabilidad de precios. Sin embargo, esta independencia plantea interrogantes en relación a la transparencia de su actuación y a los mecanismos existentes de control democrático. Posteriormente, se analizará una sentencia del Tribunal Constitucional Federal Alemán (TFC) que aborda la cuestión de legitimidad democrática en el seno del BCE, proporcionando una perspectiva legal y jurisprudencial al estudio. Finalmente, se hará una reflexión sobre la legitimidad democrática del BCE, considerando su importante papel en el contexto europeo.

[EN] This paper addresses the role of the European Central Bank (ECB) within the European Union (EU) as a key institution in the formulation and conduct of monetary policy in the euro area. The analysis focuses on how the organisational and functional structure of the ECB and the European System of Central Banks (ESCB) poses challenges to ensuring its democratic legitimacy within the framework of the prevailing constitutional democracy model in the EU. Particular reference will be made to its statutory independence in pursuit of its primary objective of price stability. However, this independence raises questions regarding the transparency of its actions and the existing mechanisms of democratic control. This will be followed by an analysis of a ruling of the German Federal Constitutional Court (FCC) that addresses the question of democratic legitimacy within the ECB, providing a legal and jurisprudential perspective to the study. Finally, a reflection will be made on the democratic legitimacy of the ECB, considering its important role in the European context.

[EU] Lan honetan Europako Banku Zentralak (EBB) Europar Batasunean (EB) duen zeregina aztertzen da, eurogunean moneta-politika formulatzeko eta gauzatzeko funtsezko instituzio gisa. EBZaren eta Banku Zentralen Europako Sistemaren (BZES) antolamendu- eta funtzioegiturak EBn nagusi den Demokrazia konstituzionalaren ereduaren esparruan legitimitate demokratikoa bermatzeko erronkak nola planteatzen dituen aztertzen du. Bereziki aipatuko da horren independentzia, legeek emana, helburu nagusiaren bila: prezioen egonkortasuna.
