Abstract

[ES]Si bien la violencia contra las mujeres no es exclusiva de determinados sectores socioculturales, las estadísticas en países con mayor tradición en inmigración señalan una mayor prevalencia de este tipo de violencia en determinadas minorías étnicas (Crowell y Burguess, 1996; Gondolf, 2002, 2005; Straus, Gelles y Steinmmetz, 1981) y en determinados grupos de inmigrantes (Dutton, Orloff y Hass, 2000; Raj y Silverman, 2002; Song, 1996). Esta sobreexposición de la mujer inmigrante en las estadísticas de la violencia machista en nuestro contexto, en una dinámica que, lejos de reducirse, parece tendente a agudizarse. En el año 2009, se realizaron más de una veintena de entrevistas con mujeres inmigrantes víctimas de violencia de género y profesionales que trabajan alrededor de esta problemática en la Comunidad Autónoma del País Vasco (CAPV) con el objetivo de visibilizar los factores estructurales que convierten, a las mujeres inmigrantes en mujeres especialmente vulnerables a la violencia machista y evaluar el funcionamiento de los recursos socio- sanitarios, jurídicos y policiales en su actuación con esta colectividad. De los resultados de la investigación, se identificó que la situación administrativa de las mujeres extranjeras, especialmente de aquellas cuyo estatus administrativo depende de su cónyuge y de las que están en situación irregular; la precariedad de sus redes sociales; dificultades de inserción sociolaboral; aquellas de tipo residencial y de acceso a prestaciones sociales básicas parecen ser elementos que dificultan salir de los ciclos de la violencia. A pesar de los avances conseguidos desde la entrada en vigor de la Ley Integral, y con el posterior desarrollo normativo en la CAPV, la protección de los derechos fundamentales de las víctimas inmigrantes, continua siendo desigual al de las mujeres autóctonas; en concreto en aquellos elementos que obstaculizan el camino de este colectivo hacia la búsqueda de asistencia socio sanitaria, protección y justicia.

[EN]Even if violence against women is not exclusive of certain social and cultural groups, statistical studies in countries with a large immigration tradition mark a higher prevalence of this kind of violence in certain ethnic minorities (Cromwell & Burguess, 1996; Gondolf, 2002, 2005; Straus, Gelles & Steinmetz, 1981) and in certain immigrant groups (Dutton, Orloff & Hass, 2000; Raj & Silverman, 2002; Song, 1996). This overexposure of immigrant women to gender violence has also been compared in our context, in a dynamic that seems to be intensifying rather than reducing itself. In 2009, more than twenty interviews with immigrant women victims of gender violence and professionals were carried out in order to identify the factors that turn immigrant women into women especially vulnerable to male chauvinism, and how the social, sanitary, legal and police resources work in their interventions with this group. From the results of the research it was identifi ed that the economic situation of immigrant women, especially of those whose economic status depends on their husband and of those who are in an irregular situation, the precariousness of their social network and their diffi culties in socio-labor integration, housing fi eld and access to basic social benefi ts seem to be factors that impede these women to get out of the violence circle. Despite the progress of the enforcement of the Integral Law and the subsequent law development in the Basque Country, the protection of the fundamental rights of immigrant victims is still unequal to the one of national women, specifi cally in those factors that hamper the way of this group to social and health assistance, protection and justice.
