La naturaleza como sujeto de derechos

Abstract

[ES] En este trabajo pretendo analizar el cambio de perspectiva del Derecho con relación a la Naturaleza y cómo esta ha ido evolucionando desde una posición ambiental instrumental y accesoria a los derechos civiles reconocidos en el Convenio Europeo de Derechos Humanos, a ser considerada como sujeto de derechos, es decir, a tener un valor intrínseco.

[EN] In this work I inted to analyze the change of perspective of law in relation to Nature and how it has evolved from an instrumental and accesory environmental position to the civil rights recognized in the European Convention of Human Rights (ECHR), to be considered as a subject of rights, that is, to have an intrinsic value.

[EU] Lan honetan bitartez, Zuzenbidearen ikuspegiaren aldaketa aztertu nahi dut naturareriko, eta nola aldatu diren Giza Eskubideen Europako Hitzarmenean (GEEH) aitortutako eskubide zibilen ingurumen-posizio instrumental era osagarri batetik, eskubideen subjeltutzat hartzeko batera, hau da, berezko balioa izatera.
