La eventual aplicación de los Reglamentos de la Unión Europea a los conflictos de leyes internos

Abstract

La entrada en vigor de los Reglamentos europeos en materia conflictual, unida a anteriores instrumentos internacionales de los que es parte España, ha puesto en evidencia la quiebra del teórico marco de unidad de norma de conflicto para los supuestos tanto internos como internacionales.Se trata de un cambio radical no sólo en lo referente al marco legal, sino también conceptual, en tanto los Reglamentos y los Convenios internacionales en la materia han venido desplazando el punto de conexión en el estatuto personal de la nacionalidad a la residencia habitual, adaptándose al modo de vida actual, en el que los cambios de residencia son cada vez más habituales. Además, en muchos supuestos hacen coincidir ius y forum, con la ventaja que ello suponer para los aplicadores del Derecho. Por todo ello se propone una necesaria adaptación del sistema conflictual interno, bien extendiendo a los conflictos internos los instrumentos supranacionales, bien sustituyendo la vecindad civil por la residencia habitual.
