Homofobia y delitos de odio a la luz de la jurisprudencia del TEDH

Abstract

[ES] El colectivo LGBT es un colectivo históricamente discriminado, que ha sufrido continuas vulneraciones en sus derechos humanos a lo largo de la historia y que, además, han sido justificadas por una sociedad homófoba, y por tanto unos tribunales, con resoluciones abiertamente homófobas. Estas vulneraciones se dan en todas sus formas, desde una violencia física contra el individuo por razón de su orientación sexual, hasta el delito de odio con palabras. Sin embargo, en Europa, el TEDH ha empezado un movimiento de garantía y protección de los derechos del colectivo LGBT, y más concretamente de los homosexuales, a los que este trabajo va enfocado, poniendo en relación la vulnerabilidad de dicho colectivo con los delitos de odio. Se inicia así el camino de una penalización de la homosexualidad hacia la protección frente a la homofobia. Este trabajo pretende mostrar esa protección que el Tribunal de Estrasburgo aporta con su jurisprudencia al colectivo homosexual.
