Postdesarrollo, pluralismo jurídico y derechos territoriales indígenas: el caso de Ecuador a la luz de la Constitución de Montecristi

Abstract

Esta tesis profundiza en el estudio de los conflictos que surgen con la defensa de los derechos de los pueblos indígenas a sus tierras, territorios y recursos naturales en el marco de los debates sobre postdesarrollo y pluralismo jurídico a partir del estudio de un contexto estatal como el del Ecuador,dominado por la doctrina jurídica monista y un modelo de desarrollo convencional-economicista.Además de identificar y estudiar el carácter de dichos conflictos, en este trabajo de tesis se muestran los avances y límites del nuevo régimen constitucional de Ecuador para encauzar y regular diferentes tipos deconflictos suscitados entre los sistemas jurídicos de los pueblos indígenas y la interpretación monistaclásica del Derecho por parte del Estado. Asimismo, y dentro del marco de vigencia de la Constitución de Montecristi, se muestran las diferentes dificultades que se plantean en la práctica para implementar untipo de pluralismo jurídico entendido en clave postdesarrollista que compatibilice los derechos reclamados por los pueblos indígenas y el Derecho estatal; y ello pese al reconocimiento de aquéllos en el texto constitucional junto con un tipo de pluralismo jurídico fuerte, y el objetivo declarado de avanzar hacia la consecución del Sumak Kawsay, respetar los derechos de la Naturaleza y constituir un Estado plurinacional e intercultural. Enmarcando todo ello en el contexto de los debates sobre el modelo dedesarrollo en el país y de las tensiones existentes sobre la interpretación del Buen Vivir entre los enfoques neodesarrollistas y postdesarrollistas.
