La prisión permanente revisable: un análisis a la luz de la jurisprudencia del Tedh y del modelo inglés

Abstract

Esta tesis doctoral tiene como objeto de estudio la regulación de la prisión permanente revisable (PPR), para lo cual se desarrolla un análisis comparado que se instrumenta, fundamentalmente, en dos parámetros que sirven de fuentes de información y contraste. El primero de ellos lo constituyen las implicaciones que se derivan de la jurisprudencia del Tribunal Europeo de Derechos Humanos (TEDH), cuyo estudio permite conocer cuáles son los límites y las garantías que, de acuerdo con la doctrina de aquel tribunal, deben respetar las penas de prisión indeterminadas y de larga duración. El segundo parámetro se localiza en el modelo de pena indeterminada existente en el Reino Unido y el sistema de revisión utilizado en ese país, que en ciertos aspectos puede ser un referente a seguir. Se pretende, de este modo, ofrecer un análisis crítico del sistema de revisión que el legislador español ha articulado para la PPR desde los criterios limitadores establecidos por el TEDH, aportando a su vez, como un posible modelo de referencia, el sistema de revisión seguido en el Reino Unido para las penas indeterminadas, ya que ofrece importantes garantías frente a una prolongación de la privación de libertad arbitraria.
