[DE] Das neue Strafgesetzbuch hat eine Änderung in der Meinung der rechtsgelehrte verursacht, der sich gegen Sexualitäts verbrechen beschützen muß, was nicht mehr “die ehrbahrkeit der frau” ist sondern “die Sexualitätsfreiheit” der Person. Das hat das Verbrechen eine neue Dimensión gegeben, basiert auf den attentat gegen die Sexualitätsfreiheit und mit der Introduktion einer Serie Erschwerungen, alte Ausdrücke wie Schändung oder Notzucht wegwerfent.

[EN] The new Penal Code has entailed a change in the concept of the judicial asset which must protect itself in sexual offenses, which is no longer “a woman’s chastity”, but rather “the sexual freedom” of the person. This has provoked a new typology of the offense in question, based on the attempt against sexual freedom with the introduction of a series of aggravating circumstances, discarding old terms suchas violation or raping of a minor.

[FR] Le nouveau Code Pénal a entraîné un changement dans le concept du bien juridique qui doit se protéger dans les délits sexuels, on ne parle plus de “la décence de la femme” mais de “la liberté sexuelle” de la personne. Ceci a provoqué une nouvelle typologie du délit en question, fondée sur l’atteinte à la liberté sexuelle tout en introduisant une série d’aggravations, bannissant ainsi des termes anciens comme viol ou stupre.

[ES] El nuevo Código Penal ha traído consigo un cambio en el concepto del bien jurídico que ha de protegerse en los delitos sexuales, que no es ya “la honestidad de la mujer” sino “la libertad sexual” de la persona. Esto ha provocado una nueva tipología del delito en cuestión, basada en el atentado contra la libertad sexual con la introducción de una serie de agravaciones, desechando antiguos términos como violación o estupro.
