Abstract

[EN] This work contains a critical consideration about article 25.2 of the Spanish Constitution which states the purpose of penalties. Moreover sorne information regarding the implementation of penalties in Spain and the situation of the penitentiary population is given. Likewise, alternatives to prison in comparative legislation, in the spanish penal Code and in the New Projet of penal Code are presented.

[FR] On réalise une réflexion critique sur l'article 25.2 de la Constitution Espagnole qui traite la finalité de la peine, on aborde en plus des données sur l'exécution des peines en Espagne et la situation de la population pénitentiaire. Aussi. on expose les alternatives à la prison dans la législation comparée, dans le Code pénal espagnel et dans le Neuveau Projet de Code pénal.

[EU] Lan honetan gogoeta kritiko bat egiten da 25.2 CE artikuluari buruz, zeinek zigorraren helburua biltzen du. Gainera, Espainian zigorren betedurari buruzko eta atxilotuen egoerari buruzko datuak aipatu egiten dira. Bestaldetik, Legegintza konparatuan, espainiar lege-liburu penalean eta lege-liburu penalaren Proiektu berrian atxiloketaren ordezko aukerak azaltzen dira.

[ES] Se realiza una reflexión crítica sobre el art. 25.2 CE en el que se recoge la finalidad de la pena. Se aportan, además, datos sobre el cumplimiento de las penas en España y la situación de la población penitenciaria. Asimismo, se exponen las alternativas a la prisión en la legislación comparada, en el Código penal español y en el Nuevo Proyecto de Código penal.
