[FR] La technique expertise constitue une science instrumentale au service de l’Administration de Justice. La preuve expertise devient un moyen de temoignage indirect et scientifique à travers laquelle le juge peut valorer et apprécier techniquement des faits qui ont été apportés au procès par d’autres moyens probatoires. En ce sens, il faut distinguer l’expertise comme moyen de preuve et l’expertise comme source de preuves: celle-ci est une activité de constatation d’une réalité ou de détermination de certains faits.

[ES] La técnica pericial se erige como ciencia instrumental al servicio de la Administración de Justicia, constituyéndose la prueba pericial como un medio de prueba indirecto y de carácter científico por el cual se pretende que el juez pueda valorar y apreciar técnicamente unos hechos que ya han sido aportados al proceso por otros medios probatorios. En este contexto, debe distinguirse la pericia como medio de prueba y como fuente de prueba. Esta última constata una realidad o determina unos hechos.

[EN] The experts’ technique is established as an instrumental science on the Administration of Justice service, being the experts’ proof an indirect and scientific way of proof, by means of which the judges want to value and appreciate technically some facts already provided to the process by other means of proof. In this context, must be distinguished the expertise as a way of proof and as a source of proof. This last one verifys a reality or determines some facts.
