La vida, el derecho y la sociedad

Abstract

[ES] La sociedad debe ser la protagonista y destinataria del mundo jurídico y el Derecho transformarse en realidad social, para conseguir una auténtica relación de causalidad entre lo que la sociedad quiere y lo que el Derecho le devuelve. Conforme a esta afirmación, y tras manifestar la importancia de la protección a la vida y a la integridad física y moral como derechos fundamentales, se reflexiona sobre el problema del aborto, la eutanasia y los transplantes de órganos, como manifestaciones jurídicas modernas de la defensa de la vida a través del Derecho.

[FR] La Société doit être la protagoniste et destinataire du monde juridique et le Droit se transformer en réalité sociale, pour atteindre une vraie relation de causalité entre ce que la société veut et ce que le Droit lui rend. D’accord avec cette affirmation, et après avoir montré l’importance de la protection à la vie et à l’intégrité physique et morale comme des droits fondamentaux, on réfléchit sur le problème de l’avortement, l’euthanasie et les greffes d’organes, comme des manifestations juridiques modernes de la défense de la vie grâce au Droit.

[EN] Society must be the protagonist and addressee of the juridical world, and Law have to turn into a social reality, to reach a real relation of causality between what the society wants and what the Law gives back to it. In accordance with this affirmation, and expressing the significance of the protection of life and moral and physical integrity as fundamental rights, it is made a reflection about the problem of the abortion, the euthanasia and the transplantation of organs, as modern juridical demonstrations of the life defence through the Law.

[EU] Gizarteak legezko munduaren protagonista eta hartzaile izan behar du, eta Zuzenbideak, errealitate sozial batetan bihurtu behar du, benetako erlazio bat egon dadin gizarteak nahi duena eta Zuzenbideak itzultzen dionaren artean. Hau esan eta gero, eta bizitza eta osasun fisiko eta moralak giza eskubide bezala babesteak duen garrantzia komentatu eta gero, abortua, eutanasia eta organu trasplanteei eginen zaie erreferentzia Zuzenbidearen bidez bizitza defendatzen duten manifestazio juridiko bezala harturik.
