Las sectas destructivas ante el derecho

Abstract

[ES] La existencia de grupos que, al amparo de la libertad religiosa, infringen la ley plantea el problema, entre otros, del peligro de la legitimación de una intervención abusiva del Estado en la esfera de la libertad de conciencia de los ciudadanos. Desde este planteamiento, se analizan los posibles delitos cometidos en el seno de las sectas religiosas, y la conveniencia de tipificar un delito sectario para proteger a las víctimas. Asimismo, se explican los intentos realizados en algunos países para hacer frente a este fenómeno.

[FR] L’existence de groupes qui, à l’abri de la liberté religieuse, violent la loi pose le problème, entre autres, du danger de la légitimation d’une intervention abusive de l’État dans la sphère de la liberté de conscience des citoyens. Partant de cette approche, on analyse les possibles infractions commises au sein des sectes religieuses et la convenance de standardiser un délit sectaire pour protéger les victimes. De même, on explique les tentatives effectuées dans quelques pays pour faire face à ce phénomène.

[EN] The existence of groups that, under protection of the religious freedom, infringe the law creates the problem, among others, of the danger related to the justification of an abusive State intervention in the citizens’ conscience freedom sphere. Starting from this approach, the potential crimes committed within the religious sects are analyzed, as well as the convenience of categorizing a sectarian crime to protect the victims. Also, the efforts, made in some countries, to face this phenomenon are explained.

[EU] Askatasun erlijiosoa medio dela, eta horren arabera legearen kontra jokatzen duten sortzen diren taldeak, nolabait herritarrek duten kontzientzia askatasuna libre eta normal erabiltzea zailtzen dute. Planteamendu honetatik abiatuta, sekta erlijiosoen barruan ematen diren delituak aztertzen dira, eta delitu horien biktimak zaintzeko delitu sektarioa tipifikatzeko konbenientzia ere azaltzen da. Amaitzeko nazio batzuetan fenómeno honen aurka egindako lanaren berri ematen da.
