[FR] L’intervention pénale contre la xénophobie et la discrimination s’est “développée“ pour faire face aux nouvelles coordonnées sociales d’un plus grand rejet à l’étranger, à l’immigrant, à celui qui est différent. Après avoir exposé l’histoire législative de la réglementation antidiscriminatoire, on examine le Droit comparé ainsi que les standards internationaux dans cette matière, en apportant ensuite quelques conclusions critiques en ce qui concerne le modèle de politique criminelle espagnol, et en s’arrêtant dans l’analyse de l’infraction de provocation.

[ES] La intervención penal contra la xenofobia y la discriminación se ha “expandido” para hacer frente a las nuevas coordenadas sociales de un mayor rechazo al extranjero, al inmigrante, al diferente. Tras exponer la historia legislativa de la normativa antidiscriminatoria, se examina el Derecho comparado así como los estándares internacionales en esta materia, aportando a continuación algunas conclusiones críticas respecto del modelo de política criminal español, deteniéndose en el análisis del delito de provocación.

[EN] The penal intervention against the xenophobia and the discrimination has “expanded” to face the new social coordinates of a greater rejection of the foreigner, the immigrant, the different one. After a commentary about the legislative history of the antidiscriminatory norms, it is examined the Compared Law as well as the international standards in this matter. Likewise, some critical conclusions related to the criminal policy Spanish model are commented, paying attention to the analysis of the provocation crime.
