El acoso inmobiliario como agravante del delito de coacciones y su posible incidencia en el concepto de violencia

Abstract

[EN] Violence as a means towards committing the offense of duress was originally interpreted as the use of physical force on a person. However, this notion was gradually broadened to what came to be called the process of “spiritualisation” of the concept of violence and encompass the use of intimidation, the use of force, and the use of psychotics and narcotics. This broader interpretation, driven fundamentally by Jurisprudence, aims to avoid any possible shortcomings with regard to suitable punishment especially in cases of what has come to be called “landlord harassment”. Any new aggravating element in the domain of the offense of duress and coertion which results in heavier legal punishment in the event that such behaviour serves to impede the proper enjoyment of the place of abode, raises further doubts as to the types of conduct that should be included in article 172.

[ES] La violencia como medio comisivo del delito de coacciones fue interpretada originalmente como fuerza física ejercida sobre una persona. No obstante, esta concepción se fue ampliando de acuerdo a lo que se denominó proceso de “espiritualización” del concepto de violencia para pasar a comprender casos de utilización de intimidación, fuerza en las cosas y uso de psicóticos y narcóticos. Esta interpretación ampliadora, propiciada fundamentalmente por la Jurisprudencia, pretende evitar supuestas lagunas de punición que pueden darse especialmente en casos de lo que ha pasado a llamarse “acoso inmobiliario”. El agregado de una nueva agravante en el ámbito del delito de coacciones, que eleva la pena en caso de que la conducta impida el legítimo disfrute de la vivienda, multiplica los interrogantes en torno a las conductas que deben quedar comprendidas en el artículo 172.

[FR] La violence comme moyen de commission du délit de contrainte à été interprété à l’origine comme la force exercée sur une personne. Cependant, cette conception a été élargie conformément au processus de « spiritualisation » de la notion de violence, afin d’inclure les cas d’utilisation de l’intimidation, de coup de force sur les choses et de l’usage des substances psychotiques et stupéfi antes. Cette interprétation plus élargie, principalement de la part de la jurisprudence, a pour but de prévenir les prétendues lacunes de punition que peuvent se produire surtout dans les cas de « l’harcèlement immobilière ».

[EU] Pertsona batekin erabilitako indar fIsiko moduan interpretatu zen, hasieran, indarkeria bortxaketadelitua egiteko bitarteko gisa. Hala ere, ikusmolde hori zabaldu egin zen indarkeriaren kontzeptuaren “espiritualizazioko” prozesua deiturikoaren arabera, eta larderia erabiltzearen, gauzetan indarra erabiltzearen eta psikotikoak eta narkotikoak erabiltzearen kasuak ere barne hartu zituen. Interpretazio zabaltzaile hori jurisprudentziak bultzatu zuen funtsean, eta balizko zigor-hutsuneak ekiditea du xede, batik bat “higiezinen jazarpena” deiturikoetan.
