Abstract

La tesis comienza por la formulación de la hipótesis principal: la indiferencia manifestada por elsistema de aplicación de la justicia penal chilena hacia los delitos con componente indígena,contraviniendo así la legislación internacional (en particular el Convenio 169 de la OIT). Para eltratamiento de esta hipótesis en el cap. I se comienza por una exposición del contexto socialteórico y conceptual, en el que se analizan cuestiones de multiculturalidad, situación depueblos originarios y sistema de género. En el cap. II se analizan las particularidades quecaracterizan la cosmovisión y la realidad del mundo andino (en especial aymara y quechua). Enel capítulo III se aborda el modo de practicar la justicia comunitaria y lo que representa lainjerencia del Derecho penal al respecto. Finalmente, en el cap. IV se detallan y analizancríticamente dos procesos penales a mujeres indígenas que resultan paradigmáticos dediscriminación interseccional.La tesis concluye confirmando la hipótesis inicial, sosteniéndose que los sistemas de justiciaordinarios impuestos a las personas miembros de pueblos originarios, vulnera sus derechosexpresamente reconocidos por el Convenio N°169 OIT, siendo totalmente injustos e ineficientesen la aplicación de justicia, al sustentarse en una igualdad jurídica formal, sin pertinenciaintercultural. También se evidenciade la investigación que las mujeres indígenas migrantes judicializadas sufren una carga mayoren su proceso, pues a diferencia de los hombres indígenas, son adicionalmente sancionadasdesde su moral (transmitida por el sistema sexo-género).
