Riforma penitenziaria o riforma penale?

Abstract

Il testo trae spunto dalle norme del disegno di legge n. 2067 in discussione al Senato e già approvato dalla Camera dei deputati, per la parte in cui prevede una delega al Governo circa la riforma dell’ordinamento penitenziario (artt. 29 e 31), tenendo conto del parere espresso in materia del plenum del CSM l’11 novembre 2015. Viene rimarcata l’esigenza, ormai irrinunciabile, di una riconsiderazione organica del sistema sanzionatorio penale, che si orienti anche a diversificare la gamma delle pene principali, secondo le indicazioni delle ultime Commissioni ministeriali che hanno affrontato tale problematica. Si sottolinea, in particolare, come il ricorso alle misure (o pene) alternative, lungi dal costituire una rinuncia alle esigenze della giustizia, corrisponda a una strategia di prevenzione generale reintegratrice, conforme alla Costituzione.
