Magistero sulla pena e pena canonica: due variabili indipendenti?

Abstract

Il lavoro propone una disamina critica della riforma del libro VI CIC, attuata nel 2021, come pure delle norme penali riguardanti i c.d. 'diritti riservati', in quanto testi finalizzati soprattutto a rendere più facilmente applicabili le pene canoniche, senza alcun significativo coordinamento con il magistero degli ultimi pontefici sul problema penale. Si evidenzia, in particolare, la carenza di una specifica riflessione sulle modalità sanzionatorie effettivamente in grado di perseguire le finalità attribuite alla pena canonica, tale da tener conto di quanto può evincersi dagli stessi sistemi penali statuali e dagli apporti della c.d. 'restorative justice'. vengono altresì considerate molte permanenti inadeguatezze sul piano delle garanzie processuali.

The author, taking the recent reform of Book VI of the Code of Canon Law as a starting point, dwells on the challenges arising from the delicta reservata in the area of child abuse. The necessary need for the protection of victims is set against the need for guarantees in favour of the offender with a view to a penal system that is not exclusively oriented towards retributive purposes, but is based on restorative justice models. Hence the critical analysis of both the recently reformed code law and its future perspectives on prevention.
