Abstract

La Corte di Cassazione ha fornito importanti chiarimenti in tema di esterovestizione ed esercizio del diritto di libertà di stabilimento. Secondo la Corte, la legittimità del giudizio di esterovestizione presuppone necessariamente l’accertamento della sussistenza di elementi di diritto e di fatto tali da indurre ad affermare con certezza la sussistenza di condotte volte ad eludere le norme tributarie. Ragionando diversamente, infatti, si rischierebbe di legittimare l’affermazione di un aprioristico, oltreché illegittimo, principio di “presunta esterovestizione” ogni volta che il contribuente abbia posto in essere strategie aziendali giustificate da valide ragioni extrafiscali, non marginali, anche di ordine organizzativo, alle quali abbia fatto seguito il conseguimento di un vantaggio fiscale.
