Abstract

Il lavoro ripercorre criticamente l’evoluzione del disegno istituzionale antitrust mettendola a confronto con gli sviluppi recenti di un approccio neoliberale in una prospettiva di policy. Il paragrafo 1 richiama i passaggi fondamentali di storia dell’analisi economica che hanno avuto come oggetto la connessione tra il mercato come luogo di autodeterminazione del soggetto e il mercato come istituzione che organizza in modo efficiente la divisione sociale del lavoro. Il paragrafo 2 discute il principio di compensazione di Kaldor Hicks e si interroga sulle ragioni per le quali il neoliberalismo odierno si affida a tale principio come criterio generale di disegno dell’intervento pubblico. Il paragrafo 3 passa in rassegna tre fasi di storia dell’antitrust, indicate come “Strutturalismo”, “Critica della Scuola di Chicago” e “Sintesi post-Chicago”, mettendo in particolare in evidenza come il consequenzialismo welfarista della sintesi post-Chicago si muova in sintonia con gli sviluppi odierni del neoliberalismo. Il paragrafo 4 analizza criticamente l’identificazione di una misura aggregata di surplus (del consumatore) come finalità dell’antitrust. Il paragrafo 5 ripercorre i principali argomenti critici emersi nel dibattito recente nei confronti di un approccio neoliberale in antitrust, mettendone in rilievo la natura di critica esterna. Il paragrafo 6 suggerisce invece un argomento di critica interna al modo in cui oggi l’analisi antitrust tende a declinare la prospettiva consequenzialista e richiama a questo proposito il contributo di J. S. Mill al dibattito della scuola utilitarista classica, avvalendosi in particolare della rivisitazione del pensiero di Mill offerta da John Rawls (2000).
