Il populismo penale

Abstract

Nella complessa epoca tardo-moderna, il senso di crisi generalizzata sta riscontrando una inedita proiezione in ambito penalistico, traducendosi nell’emersione prepotente della questione securitaria. Il presente Articolo si propone di riflettere sull’ormai ricorrente locuzione di ‘populismo penale’, che esprime proprio l’idea di un diritto penale condizionato dal perseguimento di finalità demagogiche e dalla strumentalizzazione delle componenti simboliche in ottica di rassicurazione collettiva. Dopo l’analisi dei caratteri comuni e specifici delle due anime di tale fenomeno, ossia quella legislativa e quella giudiziaria, l’Autrice abbandona la pars destruens per riflettere sulle possibili alternative all’esistente.
