Abstract

La relación entre el Reglamento “Roma I” sobre la ley aplicable a las obligaciones contractuales y los convenios internacionales sobre conflictos de leyes en materia contractual es una relación compleja. El nuevo régimen sustituye al Convenio de Roma de 19 junio 1980 sobre ley aplicable a las obligaciones contractuales (salvo en Dinamarca y en algunos territorios de ultramar), mientras que otros convenios existentes – como el Convenio La Haya de 1955 sobre ley aplicable a las ventas internacionales de mercaderías y el de 1978 sobre ley aplicable a los contratos de intermediarios – seguirán siendo aplicables en algunos Estados miembros. Exigencias de “cooperación leal” dentro de la Conferencia de La Haya de Derecho Internacional Privado y el deseo de mantener abiertos los “canales” de cooperación “universalista” realizados por los Estados miembros son algunos de los motivos detrás de las soluciones dictadas por el Reglamento en este respecto. La celebración de futuros convenios sobre conflictos de leyes en materia de contratos pertenece a la competencia externa de la Comunidad Europea. Iniciativas concretas en este sector podrían ser tomadas próximamente en el ámbito de la Comisión de las Naciones Unidas para el Derecho Mercantil Internacional, del Instituto Internacional para la Unificación del Derecho Privado y de la Conferencia de La Haya.
